YOUPI TOURS General Terms and Conditions
Corine Aujogues is the holder of the following licences and insurances, on behalf of Youpi Tours:
- A compulsory French Transportation capacity for vehicles below 9 passengers as well as an official practise authorization delivered by the French Transportation Ministry (DREAL),
- A SIREN company registration number: 849 031 166,
- A transportation insurance for each of its vehicles as well as a Civil Liability Insurance (contracted by SWISS LIFE).
All reservations imply that the customer agrees not only to Youpi Tours’ pricing policy but also to the following terms and conditions.
BOOKING AND PAYMENT
So as to book any program, you will have to comply with the validation of the General Terms and Conditions below. Booking is confirmed upon the receipt of an advance deposit (25% of the total amount due – payable online via Paypal).
Checks are authorized for French residents and bookings only. Payment in full is due on the day of the service. It can either be paid by cash, credit carD (Sum-Up) or wire transfer (see banking info page 1). Please note that payment in cash from a private individual to a professional service provider is authorized only up to 1,000 €.
MINIMUM OF PARTICIPANTS
- 2 pax under any circumstance – Youpi Tours is not a cab nor a VTC and hence not allowed to drive only one single passenger,
- 2 pax for one-day or half-day programs (6 pax maxi transportation + insurances included).
- 8 pax for scenic « apéros ».
- 12 pax for wine tastings.
- 2 pax for Dyane rides (scenic rides or apéros).
The duration and content of the service provided vary from 2 hours to a day depending on your preferences. The content ranges from wine tasting, scenic apero, foodie afternoon getaway or one-day (or half day) scenic gourmet discovery tours.
Lunches and dinners are not included in the tour price and will have to be paid directly to the selected restaurant / bistrot. The only exceptions being “apéros perchés”, foodie getaways and gourmet tour including a meal cooked after picking wild local plants.
Due to the customer
Any visit can be cancelled 72 hours prior to departure (holiday and week-ends excluded) either by phone (conversation not voice mail) with email confirmation or by regulard mail. Past this deadline, Youpi Tours entitled to keep the amount of the deposit as per late cancellation fees.
In case of last minute cancellation (less than 24 hours) or no-show, the customer will be compelled to pay the service in full.
Due to Youpi Tours
Should Youpi Tours be compelled to cancel the service – outside any case of “force majeure” – the customer will be refunded in full for its deposit. In that regard, Youpi Tours asks that each customer provides their banking information upon reservation.
Should the minimum amount of participants not the reached for a “public” tour (such as “apéro perché”) Youpi Tours should inform each party by phone at leat 24 hours prior to departure (tours never exceeding one day).
Case of « force majeure ». Both customers and Youpi Tours may have to cancel the tour by invoking « force majeure ». Such may occur for instance in case of health issue (recent doctor’s certificate should be provided), climate event (storm, heavy rains, severe frost episode) or not anticipated transportation strike. In such case, the customer will be offered the same tour at an ulterior date; should the weather or the calendar of both parties not fit, the customer will be refunded 100% of the deposit. Once again, Youpi Tours asks that each customer provides their banking information upon reservation.
During the duration of the tour (from pick up until drop off), customers accept to abide by all safety instructions provided by Youpi Tours.
Youpi Tours cannot be held responsible for external nuisances that may disturb, interrupt or worse yet prevent the smooth operation of the contractual service: poor weather conditions, strikes, protest marches or abnormal traffic.
Youpi Tours is insured by SWISS LIFE for the transportation of its passengers (2 to 7 altogether).
Such insurance covers customers when travelling abord one of Youpi Tours’ vehicles. Outside the vehicle, each tour participant (identified by the signature of a “devis” – i.e. reservation form) is covered by Youpi Tours’ civil liability insurance (same insurance company). Such civil liability insurance is valid only provided the guide’s responsabilité is involved. Should their liability be involved or should they fail to follow Youpi Tours’ safety instructions, customers fall under their own civil responsibility.
Children fall systematically under the responsibility of their parents (which includes Act L.3342-1 of the French Public Health Code forbidding to serve or sell alcoholic beverages to any customer below 18).
Moreover, Youpi Tours cannot be held responsible for hand luggage or private belongings left unattended in the vehicle.
Any dispute or litigation arising under or in connection with the agreement above will be handled by mediation, priorily to any legal or arbitration proceedings. Both parties agree as of now and without any possible ulterior discussion that this mediation mission will be exclusively entrusted to Centre de Médiation de la Drôme – 74, route de Montélier – 26000 Valence.
